Welcome to mydok.app (“MyDok”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our mobile application, website, and related services (collectively, the “Service”).
By downloading, accessing, or using MyDok, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Service immediately.
1. Eligibility and User Obligations
- You must be at least 13 years old (or older if required by local law) to use the Service.
- If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian.
- You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. User Data and Backups
- The Service allows you to store and manage personal document information, such as identification numbers, tax IDs, and document expiry dates.
- You are solely responsible for ensuring the accuracy, legality, and completeness of the information you provide.
- MyDok offers a cloud backup feature.
- By uploading or storing data on the Service, you grant MyDok a limited, non-exclusive license to process and store such data solely for the purpose of providing the Service.
3. Payment, Licensing, and Subscriptions
- The Service may be provided under a one-time payment license or other payment models made available through the App Store or Google Play.
- Payments are processed exclusively through third-party platforms (Apple App Store, Google Play). We do not directly process or store your payment information.
- A paid license grants you a personal, non-transferable, non-exclusive right to use the Service in accordance with these Terms.
- Purchases are final and non-refundable, except as required by law or by the applicable app marketplace’s refund policies.
4. Prohibited Conduct
- Use the Service for any unlawful, fraudulent, or harmful activity.
- Interfere with or disrupt the security or functionality of the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use automated systems (e.g., bots, scrapers) to access or interact with the Service.
- Infringe upon or violate the rights of others, including intellectual property and privacy rights.
5. Intellectual Property Rights
All intellectual property, including trademarks, logos, text, graphics, code, and software associated with MyDok, is the property of MyDok or its licensors. You may not reproduce, distribute, or modify any part of the Service without our prior written consent.
6. Termination and Suspension
We may suspend or terminate your access to the Service at any time, with or without notice, if you:
- Violate these Terms,
- Misuse the Service, or
- Engage in activity that may harm MyDok or other users.
Upon termination, your right to use the Service will immediately cease.
7. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind. We do not warrant that the Service will be error-free, or uninterrupted.
8. Limitation of Liability
To the maximum extent permitted by law: MyDok, its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, documents, revenue, or profits. Our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid (if any) for use of the Service in the 12 months prior to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless MyDok and its affiliates, officers, and employees from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your misuse of the Service,
- Your violation of these Terms, or
- Your infringement of any third-party rights.
10. Changes to the Service and Terms
We reserve the right to update, modify, or discontinue the Service at any time without prior notice. We may revise these Terms periodically. The updated version will be posted within the app or on our website, with a new effective date. Continued use of the Service after changes means you accept the updated Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Governing Jurisdiction – Mozambique. Any disputes shall be resolved through binding arbitration or the courts of the governing jurisdiction, unless otherwise required by applicable law.
